AlfaPay, the mobile point-of-sale solution ("App") provided by 55th Street Ventures ("we," "us," or "our"), integrates with Stripe to facilitate credit card payments. By using the App, you agree to comply with these Terms & Conditions.

User Accounts and Responsibilities

To use the App, you may be required to provide certain personal information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Services Provided

The App connects to Stripe for payment processing, allowing users to accept credit card payments. The App’s webpage details these services and any associated fees. The App utilizes Firebase services, including Firestore for storing non-personal information, and Firebase Analytics and Crashlytics for App performance and usage analysis. Mixpanel is used for additional App performance and usage analysis.

Payment and Transaction Processing

Payment processing is subject to Stripe's terms and conditions, with security measures in place to protect transaction data. Users are reminded to review Stripe’s terms for details on payment disputes and chargebacks.

Fees

Stripe Fees

Stripe’s fee structure is part of the agreement you accept when you decide to use Stripe for payment processing. Please note that these fees are set by Stripe and are subject to change based on your location. It's important to review Stripe's pricing details to fully understand the costs associated with transactions in your specific country.

The App Transaction Fee

In addition to Stripe's fees, the App charges a transaction fee of 1% for every payment processed through the App. This fee is for the use of the App's services, including the integration with payment processing systems and access to our support and maintenance services. This fee is separate from and in addition to any fees charged by Stripe or other payment processors you may use.

Intellectual Property Rights

The App and its content are owned by 55th Street Ventures. Users are granted a license to use the App under these terms, which does not include rights to copy, modify, or distribute our intellectual property.

Disclaimer of Warranties

The services provided by the App are offered on an "as is" basis. 55th Street Ventures explicitly disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the services will be error-free or that access will be continuous or uninterrupted. You acknowledge that you use our services at your own discretion and risk.

Waiver of Liability

55th Street Ventures is not liable for any losses or damages arising from the use of the App. This includes indirect, incidental, or consequential damages, including lost profits, lost data, or the cost of procurement of substitute goods or services, that arise from or relate to the use of the App. Our liability is limited to the amount you paid us to use the services in one (1) month prior to the claim.

Indemnification

Users agree to indemnify 55th Street Ventures against claims, damages, and expenses arising from their use of the App or violation of these Terms & Conditions.

Changes to Terms & Conditions

We reserve the right to modify these terms at any time, effective immediately upon posting.

Governing Law

These Terms & Conditions are governed by the laws of Canada and the province in which the user resides, without regard to conflict of law principles.

Dispute Resolution

Disputes will be resolved through arbitration in Canada, according to Canadian arbitration laws, unless otherwise required by provincial consumer protection legislation.
